What is a 66W Certificate?

A Section 66W Certificate is a certificate signed and issued by the purchaser’s solicitor / conveyancer in accordance with Section 66W of the NSW Conveyancing Act 1919.

This certificate waives the purchaser’s right to a 5 Day Cooling Off Period. The 66W Certificate (upon exchange) immediately makes the contract legally binding. The 66W Certificate is attractive to a seller as it helps to achieve a quicker sale and at the same time helps purchasers secure a property especially in a competitive buying situation. The 66W Certificate is more commonly used by purchasers considering purchasing a property prior to auction.

We strongly recommend buyers and their solicitors / conveyancers satisfactorily complete all necessary ‘Due Diligence’ relating to the property including Contract and Strata / Pest & Building Report reviews prior to requesting the issuance of a Section 66W Certificate.
