In NSW if you are considering selling your home which has a swimming pool, two ‘Prescribed Documents’ are required to be included in the Contract for Sale, namely
A Certificate of Registration
A Certificate of Compliance
The Certificate of Registration ensures the pool is registered in accordance with Section 30B of the Swimming Pool Act 1992, whilst the Certificate of Compliance is issued under Section 22D of the Swimming Pool Act 1992.
The Certificate of Compliance indicates your pool and its surroundings meets NSW Pool Standards
For Newly Constructed Swimming Pools, a valid Occupation Certificate and evidence of Swimming Pool Registration is sufficient and can be attached to the Contract For Sale in lieu of a Certificate of Compliance.
A property with a pool can be sold with a Certificate of Non Compliance however it is the purchaser’s responsibility to obtain a Compliance Certificate within 90 days of settlement.
